Terms of Service
These Terms govern your use of Forkless, the meal planning service operated by Forkless (“Forkless,” “we,” “us”). By using Forkless, including joining the waitlist, signing up, or interacting with the app, you agree to these Terms. If you don’t agree, don’t use Forkless.
1. Who can use Forkless
You need to be at least 18 years old to use Forkless. The Service isn’t directed at children, and we don’t knowingly collect personal information from anyone under 18. See the Privacy Policy for details.
By using Forkless you confirm you’re 18 or older and have the legal capacity to agree to these Terms.
2. What Forkless does
Forkless plans meals for the week, builds the grocery list, and, when you connect a retailer, submits the order. We’re currently in waitlist mode: the only Service we provide is this public website and the waitlist email list. Joining the waitlist doesn’t entitle you to access the full app, and it doesn’t create a paid subscription.
Once the full app launches, additional features (account creation, recipe management, grocery handoff, paid plans) will be governed by these Terms.
We may add, change, or remove features at any time. Forkless is early-stage software; we’ll do our best to keep it running, but we don’t guarantee uptime, performance, or any specific feature.
3. Your account
When you create an account:
- Provide accurate information.
- Keep your password confidential.
- Don’t share, sell, transfer, or hand off your account credentials.
- Maintain only one personal account.
You’re responsible for everything that happens under your account. We can suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused. You can delete your account any time from the settings page.
4. Acceptable use
Use Forkless to plan and shop for your household’s meals. Don’t:
- Scrape, crawl, or extract data from the Service by automated means, except through interfaces we explicitly provide.
- Reverse-engineer, decompile, or attempt to derive the source code, models, or logic of the Service.
- Use the Service to break the law or violate anyone’s rights.
- Submit fraudulent, abusive, or excessive grocery orders through any retailer integration, or interfere with the normal operation of the third-party services we connect to.
- Use bots or scripts that put unreasonable load on our infrastructure or that work around rate limits.
- Resell, sublicense, or commercially exploit the Service or any data obtained from it without our written consent.
- Upload content that’s unlawful, harassing, defamatory, or that contains malware.
We built this for households, not bots.
5. Your content
The recipes, meal plans, photos, and notes you submit (“Your Content”) belong to you. By submitting Your Content, you grant Forkless a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and process it solely to operate, maintain, and improve the Service for you.
We don’t sell Your Content, and we don’t use it to train AI models you haven’t opted into.
You confirm you have the rights to submit Your Content and that it doesn’t infringe anyone else’s rights or violate any law.
6. Third-party services
Forkless relies on third-party providers to deliver the Service, including grocery retailer integrations, AI language model providers, product and nutrition data sources, and an email service provider for waitlist and transactional email. Those services have their own terms and privacy practices, and you’re responsible for reviewing them.
We’re not responsible for the acts, omissions, availability, or content of any third-party service. The Privacy Policy explains what data we share with each category of provider.
7. Recipes, nutrition, and allergen filters
Forkless is a planning tool. It is not a doctor, dietitian, or substitute for professional medical advice. Recipes, nutrition estimates, and dietary filters are for general meal-planning purposes only. Always consult a qualified healthcare provider with any questions about your diet or a medical condition.
Allergen and intolerance filtering is best-effort, not a guarantee. Ingredient data can be incomplete, outdated, or wrong. Recipes can contain unlisted ingredients or cross-contamination. Manufacturers change formulations. If you or someone you cook for has a serious food allergy or intolerance, you are responsible for verifying the ingredients of every product and recipe before consumption. Forkless is not liable for adverse reactions arising from reliance on its filters or content.
8. Disclaimer of warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Forkless disclaims all warranties of any kind, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We don’t warrant that the Service will be uninterrupted, error-free, secure, or that it will meet your requirements. Beta and early-access features may contain bugs and incomplete functionality.
9. Limitation of liability
To the fullest extent permitted by law, Forkless, and its affiliates and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to these Terms or the Service.
Our aggregate liability under these Terms will not exceed the greater of (a) the amount you paid Forkless in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions don’t allow the exclusion or limitation of certain damages, so some of these limits may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold Forkless, and its officers, employees, and agents harmless from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of:
- your use of the Service;
- your violation of these Terms;
- Your Content; or
- your violation of any law or third-party right.
11. Governing law and disputes
These Terms, and any dispute arising out of or relating to them or the Service, are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Forkless, a Washington limited liability company.
Before starting arbitration, contact us at [email protected] and give us 30 days to try to resolve the dispute informally.
You and Forkless agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service that we can’t resolve informally will be settled by binding individual arbitration, rather than in court, except where prohibited by applicable law. You and Forkless waive the right to a trial by jury and the right to participate in a class action, class arbitration, or representative proceeding.
Nothing here prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction for intellectual-property infringement or unauthorized use of the Service.
12. Changes to these Terms
We may update these Terms. For material changes, we’ll give at least 30 days’ notice by email or in the app before the new version takes effect. Your continued use of the Service after that date counts as acceptance. If you don’t agree, stop using the Service before the effective date.
We’ll update the “Last updated” date at the top of this page when we make changes.
13. Termination
You can stop using Forkless any time. We can suspend or terminate your access if you violate these Terms, if continuing to provide the Service to you would expose us to legal risk, or if we discontinue the Service.
Sections that by their nature should survive termination, including Your Content (license to material we’ve already processed), Acceptable Use, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law, survive.
